    Department of Justice, United States Patent and Trademark Office, and National Institute of Standards and Technology Announce Joint Policy Statement on Remedies for Standard-Essential Patents

    Today the Justice Department, U.S. Patent and Trademark Office (USPTO), and National Institute of Standards and Technology (NIST) issued a joint policy Statement regarding the treatment of standard-essential patents (SEP) where the patent holder has agreed to license its patents on fair, reasonable, and non-discriminatory (F/RAND) terms. This Statement replaces the 2013 policy statement on SEP remedies issued jointly by the Department of Justice and USPTO.

    The 19th TRIPO Heads Meeting Held in Japan

    On December 4, 2019, the 19th TRIPO Heads Meeting was held in Kobe, Japan. CNIPA Commissioner Shen Changyu, JPO Commissioner Matsunaga Akira and KIPO Commissioner Park Won-joo attended the meeting. The three sides summarized the achievements made by them in various cooperation projects over the past year, made positive comments on the progress in trilateral cooperation, exchanged views on future trilateral cooperation and determined their cooperation plan for the next year.

    Heads of State of China and France Witnessing the Signing of Franco-Chinese Protocol on Cooperation on Geographical Indications

    On November 6, Chinese President Xi Jinping and French President Emmanuel Macron jointly witnessed the signing of the Protocol on Cooperation between CNIPA and MAA and INAO on Geographical Indications of Agriculture and Food at the Great Hall of the People in Beijing. CNIPA Commissioner Shen Changyu, French Minister of Agriculture Didier Guillaume and INAO Director General Marie Guittard signed on the Protocol respectively on behalf of the competent authorities for geographical indications of the two countries. The signing of the Protocol marks a new chapter of cooperation between the two countries in geographical indications of agriculture and food.

    International Symposium on Intellectual Property Awareness for Belt and Road Countries Held in Zhuhai

    On November 5 to 6, the International Symposium on Intellectual Property Awareness for Belt and Road Countries was held in Zhuhai of Guangdong. It was organized by CNIPA and WIPO and co-organized by Guangdong Administration for Market Regulation (Intellectual Property Office) and Zhuhai Municipal Government.

    New Rules to Sanction Trademark Filing Irregularities in Force from Dec.1

    At a recent press conference on easing market entry and improving climate for doing business, the State Administration for Market Regulation (SAMR) announced the enactment of the Rules on Regulating Trademark Filing Acts, which was released in the form of SAMR Decree No.17 and will be in force from December 1. According to SAMR Vice Minister Qin Yizhi, while executing the Trademark Law and the Rules, SAMR and China National Intellectual Property Administration (CNIPA) will continuously advance the trademark filing facilitation reform, aggressively strike the illegal acts corrupting trademark administration order and strive to generate a market climate featuring fair competition and good faith.

    Unauthorized Use of Others' Enterprise Name Abbreviation Judged as Unfair Competition

    Recently, the People's Court of Haidian District of Beijing (hereinafter referred to as Haidian Court) made a judgment on the case of Beijing Qingda Houde Institute of Education Science and Technology (hereinafter referred to as Qingda Institute) v. Beijing Qingda Cloud Education Technology Co., Ltd. (hereinafter referred to as Qingda Cloud Company), as well as Peking University for copyright infringement and unfair competition dispute, and ordered Qingda Cloud Company to compensate for the economic losses and reasonable expenses of Qingda Institute totaling 55,000 RMB.

    Logo for 70th Anniversary of Nation's Founding Protected as Special Symbol

    Recently, China National Intellectual Property Administration (CNIPA) announced that under the Administrative Regulations for Special Symbols, an application of the logo for events in celebration of the 70th anniversary of the founding of the People's Republic of China (PRC) filed by the State Council Information Office (SCIO) for special symbol registration was approved, certified to be used on all 45 categories of the International Classification of Goods and Services for the Purposes of the Registration of Marks from August 27, 2019 to August 27, 2023.

    CNIPA Opens House to Chinese Foreign Journalists

    Some 30 journalists from 19 media outlets from home and abroad including Routers, CNBC Asia-Pacific Channel, Rossiya Segodnya, Kyodo News Service and People's Daily Overseas Edition were recently ushered into China National Intellectual Property Administration (CNIPA) and its Patent Examination Cooperation Center (Beijing) to take a close look at how the nation's top IP authority practice patent examination and develop IP development policies for the nation. This event, the first of its kind, was organized by the State Council Information Office (SCIO) and CNIPA.

    PO Deputy Commissioner Shimano Kunihiko Leading a Delegation to CNIPA

    Recently, CNIPA Deputy Commissioner Gan Shaoning met JPO Deputy Commissioner Shimano Kunihiko and his delegation in Beijing. The two sides exchanged their opinions on cooperation in patent classification in the field of semiconductor, AI international conference and other issues. According to Gan, the two countries have long maintained a good partnership in IP. CNIPA and JPO have carried out extensive and in-depth exchanges in the fields of personnel cultivation, legal system, examination operation, patent documentation and classification, information construction and reexamination, and have made fruitful achievements. He hoped that both sides could make joint efforts to further deepen IP exchanges and cooperation.
