    Vice-President of the Supreme Court Put Forward Suggestions on IP Judicial Protection in Internet Environment

    In recent years, with the continuous development of science and technology, the protection of intellectual property rights in the Internet environment is facing many new situations and problems. In this regard, TAO Kaiyuan, Vice President of the Supreme People's Court, believes that all things are interconnected and it is difficult to sharply distinguish between online and offline. Therefore, from the perspective of the overall evolution, construction and reform of intellectual property legal system, the following suggestions are put forward:

    Shen Changyu Met with Deputy Director General John Sandage of WIPO

    On January 22, Commissioner Shen Changyu of China National Intellectual Property Administration (CNIPA) met with a delegation of World Intellectual Property Organization (WIPO) led by Deputy Director General John Sandage in Beijing. Shen Changyu introduced to the delegation on the latest development of China's IP cause, reviewed the important cooperation between CNIPA and WIPO, and expressed his wish for the two sides to deepen cooperation and make more fruitful achievements in the future. John Sandage conveyed the New Year greetings of Director General Francis Gurry of WIPO to CNIPA. He remarked that WIPO expects to deepen cooperation with CNIPA, and in particular, strengthen communication in fields of organization of international conferences, IP arbitration and mediation as well as PCT. During the visit of John Sandage, Deputy Commissioner He Zhimin of CNIPA made in-depth exchanges with him concerning specific matters related to cooperation in the field of PCT. It is learnt that during his stay in China, John Sandage will also visit the Patent Examination Cooperation Hubei Center of the Patent Office, CNIPA, as well as PCT users in Beijing and Wuhan.

    China to Improve Regulations on Patent Agencies

    An amended regulation on China's patent agencies will come into force on March 1. The revised regulation has made improvements in terms of qualifications for practitioners, a code of conduct and services supervision. To become qualified patent agents, individuals with the required educational background must pass a national qualification examination to get certificates, according to the regulation.

    Key Indicators of IP Make Steady Progress in 2018

    On January 10, China National Intellectual Property Administration (CNIPA) held a press conference and released statistics for the year 2018 on patents, trademarks, geographic indications (GI) and layout designs of integrated circuits. In 2018, granted invention patents in China totaled 432,000, 346,000 of which were from domestic users. Huawei (3,369), Sinopec (2,849) and OPPO (2,345) ranked top three in terms of the number of granted invention patens in China. As of the end of 2018, the grants of invention patents in China amounted to 1.602 million. The number of invention patents owned by every 10,000 people reached 11.5. In 2018, CNIPA received 55,000 PCT applications, up 9.0%; 52,000 of which were from local users, up 9.3%. The pendency for high-value patent examination was shrunk by 10% with a 52-percent reduction in complaints against patent examination.

    Commissioner Shen Changyu Visited WIPO Office in China

    On January 8, 2019, Commissioner Shen Changyu of China National Intellectual Property Administration (CNIPA) visited the World Intellectual Property Organization (WIPO) Office in China (WOC) and held a meeting with Director Chen Hongbing of WOC. Shen Changyu remarked that WOC carried out a large number of fruitful work and provided strong support for the development of China's IP cause in the past year; hopefully in the future, CNIPA and WOC may continue to strengthen cooperation, and provide stronger supports to the innovative development of China's economy. CNIPA will continue to provide supports from all aspects to WOC as always. Chen Hongbing thanked for the strong supports of CNIPA, and expressed his wish to further expand cooperation field with CNIPA and make contribution to the IP cause of China and the world.

    SIPO: Taking strong measures against low quality patent application

    IPR Daily Guide: Recently, the SIPO Party Leadership Group held a conference to discuss implementation of President Xi Jinping’s directives to strengthen IP protection as well as the central government’s policy to achieve stable and continuous development, to study new developments and to improve the quality of patent projects, and to put policy measures in place to further improve patent quality. The conference emphasized taking strong measures against low quality applications, targeting key fields and geographical areas, increasing regulatory efforts, putting together typical cases of abnormal patent application and disciplining applicants according to the law, as well as transferring suspected illegal acts to public security organs for investigation.

    Revised Regulations on Patent Commissioning To be enacted Mar. 1, 2019

    Revised Regulations on Patent Commissioning has been approved Executive Meetings of the State Council to be enacted on March 1, 2019. Revisions made to the Regulations include: the title of patent agent is modified as “Patent Attorney”; and the market access of patent agency is expanded.
