    8th China-Mongolia-Russia IP Seminar Held

    On October 21, the 8th China-Mongolia-Russia IP Seminar was held online themed on issues related to industrial design protection. Shen Changyu, Commissioner of the CNIPA, Grigory Ivliev, Director General of Russia’s Federal Service for Intellectual Property (Rospatent), and Enkhsukh Battumur, Director General of Mongolia’s Intellectual Property Office, spoke at the seminar via video link. Shen Changyu said in his speech that the three sides have maintained stable, continuous and practical trilateral cooperation in intellectual property work. The three offices have taken many measures to combat COVID-19 and promote economic, trade recovery and growth to protect the interests of global IP users. He said that China continues to improve its IP legal and working systems and has approved the 4th revision of the Patent Law, allowing industrial design protection to adapt to the development needs of the times. Shen Changyu added that the CNIPA is willing to deepen trilateral ties and bolster the construction of the China-Mongolia-Russia Economic Corridor.

    14th Five-year Plan on the National IP Development Discussed

    Site of the advanced workshop of the 4th National IP Expert Advisory Committee On September 15, the 4th National IP Expert Advisory Committee was set up and an advanced workshop was held on the national IP development during the 14th Five-year Plan period. CNIPA Commissioner Shen Changyu delivered a speech. Shen first expressed congratulations on the establishment of the Committee and issued letters of appointment to committee members, stressing that they should thoroughly implement Xi Jinping Thought on Socialism with Chinese Characteristics for a New Era and comprehensively improve their professional level to make greater contributions to building an IP powerhouse and serving the development of the country. He then introduced the latest progress in IP-related top-level design, laws and regulations, management system, IP creation, protection, application and international influence during the 13th Five-year Plan period. Since the 18th CPC National Congress, General Secretary Xi Jinping has made a series of important instructions on China’s IP work and expounded the significance, cardinal principles, objectives and tasks, initiatives and actions as well as key points of IP work, which have provided the fundamental guideline for enhancing capacity and level of IP governance.

    BRICS Heads of Intellectual Property Offices Agree to Bolster Digital Cooperation

    The BRICS countries agreed for the need to strengthen digital cooperation among member states and support for holders of intellectual property rights. The 12th Meeting of the BRICS Heads of Intellectual Property Offices was held online on August 26. CNIPA Commissioner Shen Changyu attended the meeting and delivered a speech. Dr. Shen Changyu introduced the measures CNIPA has taken against the raging COVID-19 pandemic. He stated that as the pandemic brought huge challenges to global public health, economic development and innovation, it was of great significance that the intellectual property offices of the BRICS countries work together, highlighting their commitment to providing quality service for users. The timely and effective measures taken to guarantee stable services during the outbreak were swiftly acknowledged. While ensuring the orderly progress of projects under the “BRICS Intellectual Property Offices Cooperation Roadmap,” Dr. Shen said the intellectual property offices should bolster digital cooperation to cope with the current global challenges and provide more support for intellectual property rights (IPR) holders and the public.

    IP5 Heads Hold Their 13th Annual Meeting Via Videoconference

    On July 21, the IP5 offices, namely the China National Intellectual Property Administration (CNIPA), the European Patent Office (EPO), the Japan Patent Office (JPO), the Korean Intellectual Property Office (KIPO), and the United States Patent and Trademark Office (USPTO), held their 13th annual meeting via videoconference for the first time. The videoconference was chaired by CNIPA Commissioner Dr. Shen Changyu, attended by EPO President António Campinos, JPO Commissioner Kasutani Toshihide, KIPO Commissioner Park Wonjoo and USPTO Director Andrei Iancu.

    2020 Joint Statement of the IP5 Offices

    21 July 2020 The heads of the IP5 offices, namely the China National Intellectual Property Administration (CNIPA), the European Patent Office (EPO), the Japan Patent Office (JPO), the Korean Intellectual Property Office (KIPO), and the United States Patent and Trademark Office (USPTO), held their 13th annual meeting for the first time via videoconference on 21 July 2020. The meeting was originally scheduled to be held in June in Chengdu, China, but was postponed due to the COVID-19 pandemic. The videoconference was chaired by Dr. Shen Changyu, Commissioner of the CNIPA and was also attended by the World Intellectual Property Organization (WIPO) in an observer capacity.

    Joint Statement of EPO And CNIPA on Response to Covid-19

    The European Patent Office (EPO) and the China National Intellectual Property Administration (CNIPA) stand in full solidarity with all those affected by COVID-19. After over three decades of strong bilateral co-operation, the EPO and CNIPA have built a comprehensive strategic partnership that contributes to higher quality patents and greater harmonisation in the patent system. The relationship between China and Europe is also reflected in the growing number of applications received by the EPO and the CNIPA. In 2019 the EPO received almost 30% more applications from the People’s Republic of China than in the previous year. EPC member countries also filed 42,000 invention patent applications in China, marking an increase of 4.9% over the previous year.

    CNIPA Issues Criteria on Determining Trademark Infringement

    The Criteria on Determining Trademark Infringement was introduced by the China National Intellectual Property Administration (CNIPA) to execute the plan of the CCP Central Committee and the State Council on bolstering IP protection, to provide guidelines on trademark enforcement, unify enforcement practice and enhance protection of trademark exclusive rights. The formulation of the Criteria not only conforms to the practical needs of improving trademark enforcement guidance, but also boosts a concrete measure to implement the Opinions on Strengthening IP Protection and the action plan thereof.

    Amcham China White Paper: China's IP Protection Climate Witnesses Ongoing Improvement

    In the past ten years, China has made outstanding achievements in IP protection system, and more and more American businesses believe that China's IP protection environment is improving, according to American Business in China White Paper published by the American Chamber of Commerce in China (AmCham China)in Beijing. Chinese market is leading in emerging technology adoption, including AI, 5G and autonomous driving. According to the previously released 2020 Business Climate Survey, in 2019, some 69% respondents reported China's enforcement of IPR improved in 2019, compared to 58% in 2018. These results are consistent with high-level statutory commitments by the Chinese government to continue improving the system for IPR made throughout 2019. The Foreign Investment Law Implementing Regulations include provisions for the creation of an IPR dispute mechanism and a punitive damages mechanism to improve enforcement of IPR, according to the White Paper.

    Judicial Protection of IP by Chinese Courts Improved Comprehensively

    The Information Office of the State Council recently held a press conference and released the Opinions of the Supreme People's Court on Comprehensively Strengthening the Judicial Protection of Intellectual Property, the White Paper of Intellectual Property Protection by Chinese Courts in 2019, the top 10 intellectual property cases and 50 typical intellectual property cases of Chinese courts in 2019. According to the White Paper(link for details: http://www.court.gov.cn/zixun-xiangqing-226501.html), in 2019, China's courts received 481,793 new intellectual property cases and concluded 475,853 cases, up 44.16% and 48.87% year on year.

    China’s New Civil Code Includes Punitive Damages in Intentional Intellectual Property Infringement

    The Third Session of the 13th National People’s Congress (NPC) voted and passed the “Civil Code of the People’s Republic of China” on May 28, 2020. This law will come into effect on January 1, 2021.  While referred to by the Chinese press as the Encyclopedia of Social Life, the new Civil Law includes many provisions related to intellectual property (IP).  At first read, the most striking IP provision is for punitive damages for intentional infringement, which will be potentially most valuable in patent infringement cases.
