    CNIPA Prepares for the Implementation of the New Patent Law

    To implement the decisions of the CPC Central Committee and the State Council on comprehensively strengthening the protection of IP rights, and per the requirements of the Fourth Plenary Session of the 19th Central Committee of the CPC on enhancing the powers of the central government in the field of intellectual property protection and other aspects, the Standing Committee of the National People's Congress finalized the fourth revision of the Patent Law on October 17, 2020. The revision added provisions stipulating that the patent administration department under the State Council may, upon request, handle patent infringement disputes with significant impact to the country and enforce administrative adjudication on early resolution mechanisms for drug patent disputes.

    CNIPA Deputy Commissioner Gan Shaoning Meeting Latvian Ambassador to China and Her Delegation

    On March 24, Deputy Commissioner Gan Shaoning of China National Intellectual Property Administration (CNIPA) met in Beijing with a delegation led by Maija Manika, the Latvian ambassador to China. They shared the progress of IP work in their respective countries and discussed matters such as the deepening of IP cooperation between China and Latvia. Gan Shaoning remarked that the Chinese government highly values the IP undertaking and has implemented a series of policies and measures to promote innovation and IP protection. China has always protected the IP rights of international enterprises in China in strict accordance with relevant laws while providing a good business environment for domestic enterprises. Maija Manika spoke highly of China's great achievements in IP protection. She appreciated China's legal protection of the trademark rights of Latvian enterprises in China and hoped to promote further exchanges and cooperation on IP with China. At the end of the meeting, representatives of Latvian enterprises presented a banner to CNIPA to show their appreciation.

    International Cooperation in Order to Facilitate Patent Application

    In the face of international cooperation and competition regarding the comprehensive approach to IPR protection, the China National Intellectual Property Administration (CNIPA) has long developed its goal to better serve the reform and opening-up.     CNIPA and the Supreme Court Promotes the Establishment of Online Litigation-conciliation Docking Mechanism

    The 14th Conference of Heads of Offices between CNIPA and EPO Held

    On December 4, the 14th Conference of Heads of Offices between CNIPA and the European Patent Office (EPO) was held online, attended by CNIPA Commissioner Shen Changyu and EPO President António Campinos. During the virtual meeting, the two heads reviewed their cooperation over the past year, briefed each other on the latest progress in their respective IP work, and exchanged ideas on future bilateral cooperation, especially the PCT-ISA pilot, AI, bilateral cooperation under the framework of IP5, as well as other IP-related issues of common concern.

    Amendment of the Copyright Law

    On November 11, the 23rd Meeting of the Standing Committee of the 13th National People's Congress passed a decision on amending the Copyright Law of the People’s Republic of China, which will come into force on June 1, 2021 (please click here for details). The revised Copyright Law has improved the relevant provisions of copyright protection in cyberspace, especially greatly increasing the upper limit of statutory compensation for infringement and clarifying the principle of punitive compensation, so as to further protect the legitimate rights and interests of creators.

    Patent Law Amendment Passed to Provide Stronger Protection of Patent Rights

    The 22nd session of the 13th NPC Standing Committee voted on the October 17th and approved the revised Patent Law (for details, please refer to https://www.cnipa.gov.cn/art/2020/10/18/art_ 53_ 153525.html and the attachment in Chinese). The new Law will take effect on June 1, 2021. The revision of the Patent Law mainly includes three aspects: 1. Strengthen the protection of the legitimate rights and interests of patentees, including increasing the compensation for infringement of patent rights, improving the burden of proof, improving the pre-litigation behavior preservation measures, improving the administrative protection of patent, adding the principle of honesty and credibility, adding the patent term extension system and relevant provisions on the early settlement procedure of pharmaceutical patent disputes, etc. 2. Promote the exploitation and utilization of patents, including improving the service invention system, adding patent open license system, and strengthening patent transformation services. 3. Improve the patent granting system, including further improving the design protection system, increasing the applicability situation of novelty grace period, and improving the patent evaluation report system, etc.
