    Judicial Interpretations of Anti Unfair Competition Law Issued for Public Comments

    The Supreme People's Court recently issued the Interpretations of the Supreme People's Court on Several Issues Concerning the Application of the Anti-Unfair Competition Law of the People's Republic of China (Draft for Comments) to solicit opinions from the public (see http://www.court.gov.cn/zixun-xiangqing-318221.html for details in Chinese). It includes the following main contents: The Draft defines the applicable norms of Article 2, the principle clause of the Anti-unfair Competition Law(general acts of unfair competition), i.e., where the act is not explicitly listed in the Chapter II of the Anti-unfair Competition Law (acts of unfair competition) and other relevant laws, but violates the principle of good faith and business ethics, and disrupts the market competition order, and harm the legitimate rights and interests of other business operators or consumers, the people's court may apply Article 2 of the Anti-unfair Competition Law to identify. The "other business operators" and "business ethics" stipulated in Article 2 are also clarified.

    China Issues 15-Year Plan for IPR Protection, With Legislation to Cover Big Data, AI

    China issued a plan on Wednesday for 2021-2035 to strengthen buildup and protection of intellectual property rights (IPRs), by accelerating legislation on IPRs in new fields and forms of business, such as big data, artificial intelligence (AI), algorithms and genetic technology. The country has set targets for 2025 and vowed to be deeply involved in global intellectual property governance.     The 13th BRICS Heads of Intellectual Property Offices Meeting Held

    The 13th BRICS Heads of Intellectual Property Offices Meeting (HIPO) was held virtually on August 25. Shri Rajendra Ratnoo, Controller General of Patents, Designs and Trade Marks (India) chaired the meeting.     IPR Protection Centers Expand the Work Related to Rapid Patent Confirmation

    To further strengthen the one-stop intellectual property rights (IPR) protection services of IPR protection centers covering rapid patent examination, confirmation, and protection, and implement the requirements of the Leading Party Members’ Group of the China National Intellectual Property Administration (CNIPA) of the whole-chain expansion from rapid examination to invalidation, reexamination, confirmation, and protection, CNIPA recently launched a pilot project of the multi-mode trial of patent reexamination and invalidation cases to promote the expansion of rapid patent rights confirmation.

    Implementation Rules for Fair Competition Review System Jointly Revised and Released by Five Departments

    The Implementation Rules of the Fair Competition Review System (the "Implementation Rules") have been revised by the State Administration for Market Regulation, the National Development and Reform Commission, the Ministry of Finance, the Ministry of Commerce and the Ministry of Justice, together with relevant departments, and issued recently (details in Chinese version: http://gkml.samr.gov.cn/nsjg/fldj/202107/t20210708_ 332422.html), to fully implement the fair competition review system, improve the fair competition review mechanism, and standardize and carry out the review effectively.
