    China-EU GI Agreement Begins to Pay Dividends

    Recently, the 2022 Roundtable Forum on Chinese and EU Geographical Indications was held in Brussels. The representatives of Chinese and EU political, commercial and educational circles were assembled to have an in-depth research and discussion on a wide range of topics, such as the significance of China-EU Agreement on Cooperation on, and Protection of, Geographical Indications in keeping a closer relationship between China and European Union, and the new opportunities brought by the Agreement. The forum affirmed the important role of the Agreement in the protection of Chinese and EU geographical indications.

    CNIPA Circular Targeting Squatting of World Cup-Related Trending Words

    Recently, the China National Intellectual Property Administration (CNIPA) issued the Circular on Combating Trademark Registration by Squatting "世界杯" (World Cup) and "拉伊卜"(La'eeb) and Other Words, rejecting 26 applications and invalidating one registered trademark ex officio. While the 2022 World Cup is in full swing in Qatar, a small number of companies or individuals are attempting to register with malicious intention names of renowned football stars, mascot "LAEEB"/ "拉伊卜"and other trending words or symbols, infringing social and public interest, other people's right to their names and other legitimate rights and interests, and consequently prejudicing our country's well-earned praise for stringent IP protection.

    More Chinese Brands Make Their Name Overseas

    Yu Tong pure electric buses shuttle locals and fans during the World Cup in Qatar. DJI drones fly over farms all around the world, helping farmers manage their corps. Galanz rakes in 30% of its export revenues from the Belt and Road countries. A host of Chinese brands are becoming brilliant business cards representing China in international markets. Investing in building plants and R&D centers overseas, using international e-commerce platforms for distribution, playing the culture card through products and services, buying oversea businesses directly are some of the means Chinese brands invoke to refine their branding structures, shape their images as international brands and explore broader space for development. China has amassed 21.84 trillion yuan from export in the first 11 months of the year, according to Chinese customs statistics. The confidence and vigor emanating from Chinese brands are the conviction of the Chinese economy in constant, stable and healthy development. Building a brand takes time. With incessant uptick of their quality, innovative activities and contents, Chinese brands will sail in the globe with flying colors.

    The 19th Shanghai International IP Forum Held Successfully

    The 19th Shanghai International Intellectual Property Forum, themed on "Strengthening IP Industrialization and Fueling the Innovative Growth of SMEs", was opened in Shanghai on November 18. Shanghai Party Secretary Chen Jining addressed the event. Shanghai Deputy Party Secretary/Mayor Gong Zheng joined CNIPA (China National Intellectual Property Administration) Commissioner Shen Changyu to inaugurate Shanghai IP Protection Center. Daren Tang, Director General of the World Intellectual Property Organization (WIPO) made an online speech. In his speech, Shanghai Party Secretary Chen noted the 20th CPC National Congress has sparked a new journey to build a modern socialist country in all respects and pointed strategic directions for bolstering IP work. Shanghai will carry out Chairman Xi Jinping's important instructions on IP work, fully put CPC Central Committee's decisions and deployments into operation, spare no effort to build an international IP center city based on the strategic positioning of the "Five Centers", provide robust support for speeding up the construction of a socialist, modern and international metropolis with world influence.

    Patent Law Regulation Amended to Improve IP Protection System

    Revision to guarantee implementation of rules, remedy practical challenges A regulation on helping implement the Patent Law is being amended in an effort to improve the legal system and promote high-quality development in this regard, an official from China's top intellectual property regulator said. "A new chapter concerning design applications will be added in the regulation to align with international rules, facilitating higher efficiency and quality in the patent review process," said Zhang Peng, head of the department of treaty and law with the China National Intellectual Property Administration.

    World IP Indicators: China Witnesses Substantial Growth Across the Board

    In 2021, China surpassed the U.S. to become the top jurisdiction in terms of number of patents in force with 3.6 million. China housed 37.2 million active trademarks. The largest number of design registrations in force was also in China with 2.6 million, according to the World Intellectual Property Indicators (WIPI) report 2022 unveiled by the World Intellectual Property Organization (WIPO) on November 21. The report shows that China ranked first in various indicators, reflecting the progresses China has made in IP comprehensive strength and S&T innovation capacity. Global innovation shows resilience Bucking the trend from the previous economic downturns, IP filing remained strong during the height of the COVID-19 pandemic in 2020 and soared in 2021, the report shows.

    Import Expo Seals Big Deals, Bright Future

    Combined intent transactions over the span of a year amassed 73.52 billion USD, up 3.9% compared to the previous edition. Over 2,800 companies from 127 countries and regions attended the business exhibition. A record-high 438 new products/technologies/services made their global debut. The Fifth China International Import Expo (CIIE) drew to an end at the National Exhibition and Convention Center (NECC) Shanghai on November 10, accomplishing the set objectives with flying colors and exhibiting the charisma of the Chinese market and the country's determination on opening up to the world.     OPPO to appeal Nokia patent infringement UK judgment

    Claims disputed patent is “irrelevant to 5G” Chinese vendor OPPO is to appeal a ruling by UK High Court judge MR Justice Richard Meade that the Chinese vendor infringed a Nokia patent. Courts in Germany, and the Netherlands have already found OPPO infringed one of Nokia’s patented technologies in its smartphones. The  patent  covers the processing of transmission signals in a radio transmitter (ie smartphone). There will now be hearings where the judge will consider arguments from Nokia and OPPO in relation to costs, requests for permission to appeal, and the grant of any injunction.OPPO has already suspended sales in Germany (see Mobile News, August).
